Facemask Penalty

Had a discussion last night about the facemask penalty.  I have a player that is big and when he plays defense, he defeats his blocker by slapping the blocker's helmet to the side.  Is this or is this not a penalty?

Rule 9-4, Article 7 - Illegal Personal Contact:

ART. 7 . . . No defensive player may use the hand(s) to slap the blocker’s head.

A head slap has been illegal for a while.  Deacon Jones lived on it, but you don't see it anymore.
